WAIVER AND RELEASE OF LIABILITY
AND
ASSUMPTION OF RISK AGREEMENT
Each member of Telemark Biathlon Club, (the “Club”), individually, and on behalf of his or her minor children hereby agrees to the following terms and conditions:
As a member of Telemark Biathlon Club I agree to ensure that I am also a member in good standing of United States Biathlon Association and that Telemark Biathlon Club operates as a member of the United States Biathlon Association. I ensure that I am Basic Rifle Safety certified through US Biathlon. I also ensure that I will follow all best practices as established by US Biathlon for use of the range, including doing so only in the presence of a Range Safety Officer. I assume the risk of injury to person or property resulting from any of the dangers and risks of recreational, educational, and other activities occurring during Club activities including, skiing, rollerskiing, running, strength training, biathlon shooting and bicycling, known and unknown, and I RELEASE and DISCHARGE the Club, its Directors and its volunteers for any injury resulting from any of the dangers and risks of such recreational activities, including changing weather conditions, snow conditions, bare spots, rocks, stumps, trees, collisions with natural or manmade objects, or the activities of other persons, variations in terrain.
I further understand that by signing this agreement I acknowledge that Nordic, biathlon, running, mountain bicycling and related activities are HAZARDOUS. I understand and accept that falls and collisions do occur and injuries may result; therefore, I assume the burden, and individual responsibility for myself.
Furthermore, I accept all risk of injury, including but not limited to injury or death caused in whole or in part by the negligence or carelessness of the Club, volunteers acting on behalf of the club, or its Officers, and/or Directors in the operation and management of the Club and in maintenance of the groomed and ungroomed surfaces, paved trails, training facilities or bicycling trails and all other areas where Club activities occur. As a member of the Club I agree and accept the responsibility of inspecting the facilities, equipment, trails, and equipment and I understand that if I find anything is unsafe, I will immediately advise the Club, a Director, or Coach of such condition and I shall refrain from participating until satisfied such condition is corrected.
I understand that the Telemark Biathlon Club is a voluntary organization run by volunteer Officers and Directors who may have no special training or education in the creation, maintenance, and operation of a biathlon or training venue. I also understand that at no time shall I allow non-Club members to use any of the equipment or participate in Club training and events without the completion of their own registration and waiver.
I acknowledge that the Club may offer other activities and social events unrelated to skiing including, but not limited to camping, hiking, picnics, parties and other social events. My participation in any of these activities may involve danger resulting in injury and I agree that I participate in these activities at my own risk. I agree to HOLD HARMLESS and RELEASE and DEFEND the Club, its Officers, and Directors from all claims that arise from, or be in any way related, to these activities or events.
I understand that alcohol may be served or made available at functions held on behalf of the Club. I take full and unconditional responsibility for my own actions and the actions of my guests at any function that I may host for the Club. I further agree that I will not serve or provide alcohol to any person under the age of 21 at any time for Club events. I agree to HOLD HARMLESS and RELEASE and DEFEND the Club, its Officers and Directors from all claims or actions arising from any Club activities.
I understand that occasionally members involved in activities and/or events may be photographed, videotaped or interviewed and thus these images, information or their competition results may appear on club web sites or be used in publicity, publications, and/or public relations activities. I agree to HOLD HARMLESS and RELEASE and DEFEND the Club, its Officers and Directors from all claims or actions arising from the use of these images or information.
